PRIVACY POLICY

By engaging our services, you acknowledge and agree to abide by these terms and conditions in their entirety. The payment of the reservation detailed in this document will accept as good and valid all the terms and conditions that are detailed below:

Security

1. The Company ensures that all yachts are properly maintained and comply with safety regulations.
2. Yacht availability is subject to prior reservations and scheduling constraints.
3. Clients are responsible for adhering to safety guidelines and regulations provided by the Company, including but not limited to onboard safety instructions and restrictions.
4. Clients are responsible for any damage caused to the yacht or its equipment during the rental period.
5. While the yacht is in movement, the guests have to be on either the flybridge or stern, depending on the yacht either one or both.
Client
6. No towels, sunscreen, or seasickness pills will be provided, guests will need to bring their own.
7. Shoes cannot be worn in the yacht, these have to be taken off once entering the vessel, while barefoot, no carpeted areas can be entered if wet.
8. Catering service is not included in the starting package or available for all vessels, this can be added in menus, which will appear in the first page of this document and depend on season and availability.
9. Regarding alcoholic beverages, all guests over 18 years old are allowed to drink, this can be either add as a service or you may bring your own.
10. On the boat/yachts it is totally forbidden to smoke cigarettes, e-cigarettes, habanos, jucas, shishas, vapes, cigars, etc., the breach of this prohibition by any of the people participating in the activity detailed above will lead to the return to dock and cancellation of excursion.

Activities

11. In most boats snorkel or some kind of floatie will be available, ask before time to have everything prepared in case of wanting it, this has no extra charge.
12. Other water activities such as, scuba diving, larger floaties, catapult, etc. have an extra charge and are part of our “Fun in the Sun” pack and has to be reserved previously, at least 48 hours.
13. Clients agree to comply with all applicable laws, regulations, and policies during the rental period, including those pertaining to activities like scuba diving.
14. The Company shall not be liable for any loss, damage, injury, or death resulting from the use of our yacht rental services, including activities like scuba diving, snorkeling, or any other recreational activities undertaken during the rental period. Clients engage in such activities at their own risk, freeing the company; Punta Cana rental Yachts of any responsibility.
15. Clients must follow all safety instructions provided by the Company, including but not limited to onboard safety guidelines, emergency procedures, and restrictions.

Cancellation or Relocation

16. In case where the client cannot make the excursion due to having COVID 19, with a positive test provided to the company, the reservation will be kept for 14 months, if in those 14 months the client cannot take the excursion, none of the amounts paid in advance will be reimbursed.
17. In the event that the weather conditions prevent the celebration of the excursion, an alternative date or route, even vessel in some cases will be provided, but In the event that the client is the one who declines all the alternative routes and dates or vessel (which will be equivalent in price), no refund will be made.
18. If the client does not attend at the departure time of the excursion, the company will not return any amount that has been delivered by the client having to pay the entire contracted excursion. If the client will not be able to attend the appointment, he must notify 48 hours before and the company will relocate the client on another day so that they can enjoy the trip. If the client declines the offer, no amount paid will be refunded.
19. Not complying with the rules of the vessel, these rules will be explained when boarding again, failure to comply will lead to the return to dock and cancellation of the excursion due to potential risks regarding the guests and crew.
20. Cancellation requests must be made in writing or through the Company’s designated communication channels.
21. Refunds for cancellations made within 48 hours of the rental start time will not be provided.
22. Cancellations made within 48 hours will have to pay in full the price of the trip.
23. In the event of cancellation prior to 48 hours before the rental start time, the Company may, at its discretion, provide a partial refund after deducting any administrative fees or charges (the reservation fee), the refund will take place in the approximate 15 working days.
24. Once the client is onboard and makes the last payment after revising the vessel, no refund will be made of any kind, understanding they agree and are content with the vessel, date, area, terms & conditions, etc.

Company

25. All photographs made by the photographer are owned by the company, if the client wants to buy them, they have the possibility of doing so, understanding that the photos are and will be used by the company in different social medias or for future clarification.
26. Reservations are subject to availability and are confirmed only upon receipt of the required payment understanding and agreeing with the terms and conditions/rental agreement.
27. The Company reserves the right to refuse or cancel a reservation without providing a reason.
28. Payment for the rental must be made in full prior to the commencement of the rental period, as specified in the rental agreement.
29. For the clients and company’s safety various camaras are positioned in different areas of the vessel, once the trip is finished these films will be saved for the next 6 months.
30. If one of the guests is pregnant, has a disability, an allergy, minors, infants or babies or is in need of any other attention, care, etc. the company should be notified prior to the trip for everyone’s safety.
31. A contract will be given to the client before starting the trip. This contract has to be signed for the trip to start, and if not signed the trip will be canceled and no refund will be given.
